1. Introduction and Company Information

These Terms of Service (“Terms”) govern your relationship with Mytruffl, a service operated by Truffl (“we,” “us,” or “our”), a company incorporated under the laws of France.

2. Acceptance of Terms

By creating an account or accessing mytruffl.com, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, you must not use the service. Your acceptance is recorded at the time of account creation and constitutes a binding agreement.

3. Nature of the Service — Intermediary Role Only

Mytruffl is a technical intermediary. Our sole function is to aggregate and transmit publicly available or third-party sourced business contact information (“Lead Data”) to you, the user. We do not generate, create, verify, own, or control the underlying data. We do not participate in, supervise, or take any responsibility for what you do with that data once it has been delivered to you.

We are not a data controller for outreach purposes. When you use Lead Data to contact third parties, you act as an independent data controller in your own right. Mytruffl has no involvement in, and accepts no responsibility for, any communication, transaction, relationship, or dispute arising between you and any individual whose contact information was obtained through the platform.

No editorial control. We do not review, endorse, or validate the accuracy, completeness, currency, or legal status of any Lead Data. The presence of a contact in our results is not an endorsement or representation of any kind.

4. User Accounts

You must provide accurate and complete information when creating your account. You are solely responsible for all activity that occurs under your account and for maintaining the confidentiality of your login credentials. You must notify us immediately at contact@mytruffl.com if you suspect any unauthorized use of your account.

5. User Responsibilities — You Are Solely Responsible

Full legal responsibility rests with you. By using the service, you expressly acknowledge and agree that:

• You are the sole controller and decision-maker regarding how you use, store, process, and act upon any Lead Data obtained through the platform.
• You are solely responsible for ensuring your use of Lead Data complies with all applicable laws in your jurisdiction, including but not limited to: GDPR (EU), CAN-SPAM Act (US), CASL (Canada), PECR (UK), and any other anti-spam, data protection, or privacy legislation.
• You are solely responsible for obtaining any lawful basis required under applicable law before contacting any individual whose data was obtained through the platform.
• You are solely responsible for any claim, complaint, fine, penalty, or legal action brought by a third party (including regulators, individuals, or companies) arising from your use of Lead Data.
• You will not use the service to send unsolicited commercial communications in violation of applicable law.
• You will not use the service to harass, stalk, threaten, or cause harm to any individual.
• You will not resell, sublicense, or redistribute Lead Data to third parties without explicit written consent from us.
• You will not attempt to reverse-engineer, scrape beyond normal use, or systematically extract data from the platform.

Mytruffl bears no responsibility whatsoever for how you use any data delivered through the service. If a claim arises from your use of Lead Data, you agree that Mytruffl is not a party to that dispute and that you will not implicate Mytruffl in any related legal proceedings.

6. Intellectual Property

The service, its interface, software, and original content are and will remain the exclusive property of Truffl and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the service solely for your own legitimate business prospecting purposes, subject to these Terms. This license does not include any right to reproduce, distribute, or create derivative works from the platform or its outputs at scale.

7. Billing, Auto-Renewal, and Refunds

Subscription billing. Paid subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method for the applicable fee on each renewal date.

Auto-renewal. Subscriptions automatically renew at the end of each billing cycle unless you cancel at least 24 hours before your next renewal date. You may cancel at any time through your account billing portal or by contacting us at contact@mytruffl.com.

Refunds. Except where required by applicable law, paid subscription fees are non-refundable. If you believe you were charged in error, contact us within 14 days of the charge.

Price changes. We may change subscription prices with at least 30 days’ advance notice. Continued use after the effective date constitutes acceptance of the new pricing.

8. Truffs (Credits) System

Our service uses a credit-based system called “Truffs” to manage access to lead generation and enrichment features. Truffs are consumed each time you perform a search or enrich a lead.

8.1 Allocation

Free tier users receive a limited one-time allocation. Paid subscribers receive a monthly Truffs allocation based on their plan.

8.2 Reset Policy

Unused Truffs do not roll over to the next billing cycle. At the start of each new billing period, your Truffs balance is reset to your plan’s monthly allocation.

8.3 Account Cancellation

When a subscription ends or is canceled, your access to premium features and remaining Truffs is forfeited at the end of the current billing period. Unused Truffs have no monetary value and are not refundable.

9. No Warranties — Service Provided “As Is”

The service and all Lead Data are provided “as is” and “as available” without any warranty of any kind, express or implied. To the fullest extent permitted by applicable law, Mytruffl expressly disclaims all warranties, including but not limited to:

• Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
• Any warranty that the service will be uninterrupted, error-free, or free of viruses or other harmful components.
• Any warranty regarding the accuracy, completeness, currency, legality, or deliverability of any Lead Data.
• Any warranty that Lead Data complies with the laws of your jurisdiction or is appropriate for your intended use.

You use the service and all Lead Data entirely at your own risk.

10. AI Limitations and Data Accuracy

Our platform uses artificial intelligence and third-party data sources to locate and present business contact information. AI-generated results may contain errors, outdated information, or inaccuracies. We make no guarantee whatsoever as to the accuracy, deliverability, completeness, or legal status of any data provided.

You are solely and entirely responsible for verifying any data before use, and for ensuring that your intended use is lawful. Mytruffl accepts no liability for any consequence arising from your reliance on data provided through the service.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Mytruffl, its officers, directors, employees, agents, suppliers, and affiliates shall not be liable for any damages of any kind arising from or related to your use of the service, including but not limited to:

• Any claim by a third party resulting from your use of Lead Data (including regulatory fines, spam complaints, or privacy claims).
• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, goodwill, or business opportunities.
• Damages arising from service interruption, data inaccuracy, or platform errors.

Liability cap. To the extent Truffl is found liable for direct damages, our total cumulative liability shall not exceed the greater of: (a) the total fees paid by you in the twelve (12) months preceding the claim, or (b) €100 EUR. This cap applies regardless of the form of action and even if we have been advised of the possibility of such damages.

12. Indemnification

You agree to defend, indemnify, and hold harmless Truffl and its officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of or reliance on any Lead Data obtained through the service.
• Any outreach, communication, or commercial activity you conduct using Lead Data.
• Your violation of these Terms or any applicable law or regulation.
• Your violation of any third-party right, including any privacy, intellectual property, or consumer protection right.
• Any claim by a regulator, individual, or third party arising from your use of the service.

This indemnification obligation survives termination of these Terms and your use of the service. If Mytruffl is named in any legal proceeding arising from your use of the service, you agree to take all reasonable steps to have Mytruffl removed as a party and to bear all related costs.

13. Affiliate Program

Truffl offers an optional affiliate program under the following terms:

Eligibility. Any registered Truffl user may participate. Participation constitutes acceptance of these affiliate terms.

Rewards. Affiliates earn a one-time cash reward for each new user who subscribes to a paid plan using the affiliate’s unique referral link: $5 USD for a Lite plan subscription and $15 USD for a Starter plan subscription. Rewards are credited in USD and paid via PayPal upon request.

Eligibility conditions. A reward is only earned when: (i) the referred user is a new Truffl account, (ii) the referred user completes a paid subscription using the affiliate’s referral link, and (iii) the payment is not subsequently refunded or charged back.

Prohibited conduct. Self-referrals, fake accounts, paid advertising mimicking Truffl’s own ads, spam, or any fraudulent activity will result in forfeiture of all pending rewards and termination of access.

Payment. Payouts are processed within 48 hours of a request sent to contact@mytruffl.com. Truffl is not responsible for delays caused by PayPal or incorrect payment details.

Taxes. Affiliates are solely responsible for reporting and paying applicable taxes on earnings.

Modification. Truffl may modify or discontinue the program at any time with notice. Rewards accrued before termination will be honored for 90 days.

No employment relationship. Participation does not create an employment, partnership, or agency relationship.

14. Termination

We reserve the right to suspend or terminate your access to the service at any time, with or without notice, if we determine in our sole discretion that you have violated these Terms, engaged in abusive or illegal conduct, or posed a risk to other users or third parties. Upon termination, your right to use the service ceases immediately and any remaining Truffs are forfeited without refund.

15. Governing Law and Dispute Resolution

Governing law. These Terms are governed by the laws of France, without regard to conflict-of-law provisions.

EU users. If you are a consumer in the EU, you retain the benefit of mandatory protections under the laws of your country of residence and may bring claims before your local courts.

Non-EU users. For users outside the EU, disputes shall first be addressed through good-faith negotiation for 30 days. If unresolved, disputes shall be submitted to binding arbitration or courts of competent jurisdiction, at our mutual election. Emergency injunctive relief may be sought by either party at any time.

EU Online Dispute Resolution. EU consumers may use the European Commission’s ODR platform at ec.europa.eu/consumers/odr.

16. Changes to These Terms

We may modify these Terms at any time. We will provide at least 14 days’ advance notice of material changes via the platform or email. Continued use after the effective date constitutes acceptance. If you do not agree to the revised Terms, you must stop using the service before the effective date.
